1. About ReviewByCard

ReviewByCard provides tools and services designed to help businesses and users collect, manage, display, and/or share customer reviews and feedback.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

2. Eligibility

You must be legally capable of entering into a binding agreement to use ReviewByCard.

If you use ReviewByCard on behalf of a business or organization, you confirm that you have the authority to accept these Terms on its behalf.

3. Accounts

You are responsible for:

• Keeping your login credentials confidential;
• Maintaining the security of your account;

4. Reviews and User Content

ReviewByCard may allow users or businesses to submit reviews, ratings, comments, images, text, or other content (“User Content”).

You are solely responsible for the User Content you submit.

By submitting User Content, you confirm that:

• You have the right to submit the content;
• The content is truthful and not intentionally misleading;
• The content does not violate any applicable law;
• The content does not infringe another person’s intellectual property, privacy, or other rights;
• The content does not contain unlawful, threatening, defamatory, abusive, or fraudulent material.

You must not submit fake, manipulated, or misleading reviews, including reviews created or submitted for the purpose of artificially influencing a rating or reputation.

ReviewByCard reserves the right, but does not necessarily have the obligation, to remove or restrict User Content that we believe violates these Terms or applicable law.

5. License to User Content

By submitting User Content to ReviewByCard, you grant ReviewByCard a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content as reasonably necessary to operate, provide, improve, and promote the Service.

This license continues for as long as necessary for ReviewByCard to provide the relevant Service, subject to applicable law and our Privacy Policy.

You retain ownership of your User Content.

6. Business Use

If you use ReviewByCard to collect or display reviews for a business, you are responsible for ensuring that your use of the Service complies with all applicable laws, regulations, advertising requirements, and platform rules.

You must not:

• Create or encourage fake reviews;
• Offer misleading incentives for positive reviews;
• Manipulate ratings or review results;
• Impersonate customers or other individuals;
• Use ReviewByCard to harass or deceive customers;
• Use the Service for unlawful or fraudulent activities.

7. Acceptable Use

You agree not to misuse the Service.

If ReviewByCard offers paid plans or subscriptions, the applicable prices and billing terms will be presented to you before purchase.

Unless otherwise stated:

• Subscriptions may automatically renew for the applicable billing period;
• You authorize ReviewByCard or its payment provider to charge the applicable fees;
• Fees are generally non-refundable except where required by law or expressly stated otherwise;
• We may change pricing with reasonable notice.
• If a payment fails, we may suspend or restrict access to paid features until the outstanding amount is resolved.

9. Intellectual Property

The ReviewByCard website, software, branding, logos, designs, text, graphics, and other materials provided by ReviewByCard are owned by or licensed to ReviewByCard and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, or commercially exploit ReviewByCard’s intellectual property without our prior written permission.

You retain ownership of content that you independently own and submit to the Service, subject to the license described in these Terms.

10. Third-Party Services

ReviewByCard may integrate with or link to third-party websites, platforms, payment providers, analytics services, or other services.

Third-party services are governed by their own terms and policies. ReviewByCard is not responsible for the availability, security, accuracy, or practices of third-party services.

Your use of ReviewByCard may involve the collection and processing of personal information.

12. Service Availability

We aim to keep ReviewByCard available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

13. Disclaimer

To the maximum extent permitted by applicable law, ReviewByCard provides the Service on an “as is” and “as available” basis.

• Reviews or other User Content will be accurate, complete, or reliable;
• The Service will produce a particular business or financial result.
• Reviews and opinions expressed by users are the responsibility of the individuals who submit them and do not necessarily represent the views of ReviewByCard.

14. Limitation of Liability

To the maximum extent permitted by applicable law, ReviewByCard and its owners, employees, affiliates, partners, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ReviewByCard and its owners, employees, affiliates, and service providers from claims, damages, losses, liabilities, and expenses arising from:

Your violation of these Terms;

• Your User Content;
• Your misuse of the Service;
• Your violation of another person’s rights;
• Your violation of applicable laws or regulations.

16. Suspension and Termination

You may stop using the Service at any time.

We may suspend or terminate your access to ReviewByCard if we reasonably believe that you have violated these Terms, engaged in unlawful or abusive behavior, created a security risk, or otherwise misused the Service.

Upon termination, provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, User Content, disclaimers, liability, indemnification, and dispute resolution.

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the top of this page. Where required by law, we will provide additional notice of material changes.

Your continued use of ReviewByCard after updated Terms become effective means that you accept the revised Terms.

Any disputes relating to these Terms or the Service will be handled by the competent courts of the applicable jurisdiction, subject to any mandatory consumer rights or dispute-resolution requirements.

These Terms, together with any additional terms or policies expressly referenced in them, constitute the agreement between you and ReviewByCard regarding your use of the Service.
